Welcome to Braaand, a collaborative design and brand platform provided by Nitti AI AB (“Nitti AI,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of Braaand, including our website, platform, applications, AI features, premium features, and related services, collectively referred to as the “Services.”

By creating an account, accessing, or using the Services, you agree to these Terms. If you use the Services on behalf of an organisation, such as your employer, client, or team, you represent that you have authority to accept these Terms on behalf of that organisation.

If you do not agree to these Terms, you may not use the Services.

1.Who Provides the Services

Braaand is a product provided by Nitti AI AB, a company based in Sweden.

References to “Braaand” in these Terms refer to the product, platform, and Services. References to “Nitti AI,” “we,” “us,” or “our” refer to the legal entity providing the Services.

2.Accounts and Organisations

To use certain parts of the Services, you may need to create an account. You agree to provide accurate and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

If your account is connected to an organisation or workspace, administrators of that organisation may be able to manage your access, invite or remove users, view workspace activity, control settings, and access content associated with that workspace.

You may not share account credentials or allow another person to use your personal account.

3.Right to Use the Services

Subject to these Terms, Nitti AI grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your own business, professional, internal, or authorised organisational purposes.

You may not copy, resell, sublicense, modify, reverse engineer, or attempt to extract the source code of the Services, except to the extent such restriction is not permitted by applicable law.

All rights not expressly granted to you are reserved by Nitti AI.

4.Customer Content

You and your organisation retain ownership of files, designs, brand assets, images, text, comments, prompts, outputs, and other materials that you upload, create, submit, or store in the Services (“Customer Content”).

By using the Services, you grant Nitti AI and our service providers the limited rights necessary to host, store, process, display, transmit, secure, maintain, troubleshoot, and improve the Services.

We do not claim ownership of Customer Content.

You are responsible for ensuring that you have the rights and permissions needed to upload and use Customer Content in the Services. You are also responsible for ensuring that Customer Content does not violate applicable law, third-party rights, or these Terms.

5.AI Features and Credits

Braaand may include features that use artificial intelligence or machine learning (“AI Features”). These features may allow you to generate, edit, transform, analyse, or suggest content based on prompts, uploaded materials, workspace data, or other inputs.

AI Features may be subject to limits, usage quotas, or credits (“AI Credits”). We may charge for AI Credits, include them in paid plans, or make them available as add-ons.

AI-generated outputs may not always be accurate, complete, unique, or suitable for your intended purpose. You are responsible for reviewing and validating any AI-generated content before relying on it or publishing it.

Unless otherwise stated, you retain any rights you may have in your inputs, and we assign to you any rights we may have in outputs generated for you, to the extent permitted by law and subject to your compliance with these Terms.

You may not use AI Features to generate unlawful, infringing, deceptive, harmful, or abusive content, or to violate the rights of others.

6.Acceptable Use

You agree not to use the Services to:

  1. violate any applicable law or regulation;
  2. infringe or misappropriate intellectual property, privacy, publicity, or other rights;
  3. upload malware, harmful code, or content intended to disrupt the Services;
  4. attempt to gain unauthorised access to the Services or related systems;
  5. probe, scan, or test the vulnerability of the Services without our prior written permission;
  6. interfere with or degrade the performance, security, or availability of the Services;
  7. scrape, crawl, or harvest data from the Services except as expressly permitted;
  8. impersonate another person or misrepresent your affiliation with an organisation;
  9. use the Services to send spam or abusive communications;
  10. use the Services to develop a competing service by copying features, workflows, or user interface elements; or
  11. encourage or assist anyone else to do any of the above.

We may remove content, restrict access, or suspend accounts if we believe these Terms have been violated or if continued use creates legal, security, or operational risk.

7.Third-Party Services

The Services may depend on or integrate with third-party services, platforms, infrastructure, APIs, models, or tools. These may include hosting, authentication, database, analytics, payment, AI, or other service providers.

Third-party services are not controlled by Nitti AI and may be subject to their own terms and privacy policies.

We are not responsible for third-party services except to the extent required by applicable law or expressly stated in a separate agreement.

8.Beta and Early Access

Braaand is a new product and may include beta, experimental, preview, or early access features. These features may be incomplete, change frequently, contain bugs, produce unexpected results, or be discontinued.

We may add, change, limit, suspend, or remove features at any time. We may also impose usage limits or technical restrictions where needed to maintain security, reliability, or performance.

You should not rely on beta or early access features for critical operations without appropriate backup and review.

9.Fees, Billing, and AI Credits

Some parts of the Services may be free, while others may require payment, a subscription, premium plan, usage-based billing, AI Credits, or another paid arrangement.

Prices, plan features, AI Credit amounts, usage limits, renewal terms, and billing intervals may be shown in the Services, on our website, or agreed separately.

If you purchase a paid plan, premium feature, subscription, or AI Credits, you agree to pay all applicable fees and taxes. Unless otherwise stated, fees are charged in advance and are non-refundable to the extent permitted by law.

Subscriptions may renew automatically unless cancelled before the end of the current billing period. If automatic renewal applies, we will provide information about renewal terms before purchase or as otherwise required by law.

AI Credits may be limited by time period, plan, workspace, user, or feature. Unless otherwise stated, unused AI Credits do not convert to cash, are not refundable, and may expire or reset according to the applicable plan or purchase terms.

We may change prices, plan features, billing models, or AI Credit terms. Changes to existing paid subscriptions will normally apply from the next renewal period unless otherwise stated or required by law.

Failure to pay fees when due may result in suspension, downgrade, limitation, or termination of access to paid features or the Services.

10.Feedback

If you provide feedback, ideas, comments, or suggestions about the Services, you grant Nitti AI the right to use them without restriction or compensation to you.

This helps us improve Braaand, but does not affect your ownership of Customer Content.

11.Privacy and Data Protection

Our processing of personal data is described in our Privacy Policy.

Where we process personal data on behalf of a customer organisation, we do so as a processor in accordance with applicable data protection law and any applicable data processing terms.

12.Confidentiality

During your use of the Services, you may receive access to non-public information about Braaand, including product plans, designs, technical information, pricing, security information, or beta features.

You may not disclose such non-public information unless we have authorised you to do so or disclosure is required by law.

13.Suspension and Termination

You may stop using the Services at any time.

We may suspend or terminate your access to the Services if:

  1. you breach these Terms;
  2. payment is overdue;
  3. your use creates security, legal, operational, or reputational risk;
  4. we are required to do so by law;
  5. your account is inactive for an extended period; or
  6. we discontinue the Services or relevant part of the Services.

Upon termination, your right to use the Services ends. We may delete Customer Content after a reasonable period, subject to applicable law, backup retention, and any separate agreement with your organisation.

14.Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the extent permitted by law, Nitti AI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of availability, accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or that Customer Content will never be lost or corrupted.

You are responsible for maintaining appropriate backups of important Customer Content.

15.Limitation of Liability

To the extent permitted by applicable law, Nitti AI will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, business opportunity, data, or Customer Content.

To the extent permitted by applicable law, Nitti AI's total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the amount paid by the customer to Nitti AI for the Services during the twelve months preceding the event giving rise to the claim.

If the customer has not paid any fees for the Services, Nitti AI will have no liability for monetary damages to the extent permitted by applicable law.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.

16.Changes to the Services or Terms

We may update the Services and these Terms from time to time.

If we make material changes to these Terms, we will take reasonable steps to notify you, such as by posting the updated Terms in the Services, on our website, or by email.

Your continued use of the Services after updated Terms become effective means that you accept the updated Terms.

17.Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.

18.Governing Law and Disputes

These Terms are governed by the laws of Sweden, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved by the courts of Sweden, unless mandatory law provides otherwise.
